Membership Terms of Service

By purchasing, enrolling in, renewing, or using any membership, product, service, or license-related offering provided by NJ Real Estate Referral Company LLC, you agree to be legally bound by the following Membership Terms:

1. Eligibility; No Guaranteed Acceptance
Membership and related services are offered only to individuals who are legally eligible and, where applicable, properly licensed or entitled to seek a license-related transaction under applicable New Jersey law, rules, and regulations. Submission of a payment, form, application, or request does not create membership, does not constitute acceptance, and does not guarantee approval of any membership, renewal, transfer, reactivation, status change, or other license-related request. NJ Real Estate Referral Company LLC reserves the absolute right, in its sole discretion, to approve, deny, delay, suspend, or terminate any request, membership, or service.

2. Member’s Duty to Provide Accurate and Complete Information
You represent and warrant that all information, documents, statements, selections, and submissions you provide are true, accurate, current, complete, and not misleading. You are solely responsible for verifying the accuracy of all information submitted, including but not limited to your name, contact information, license number, license type, license status, brokerage history, renewal status, education status, and any other information relevant to your request. NJ Real Estate Referral Company LLC shall have no liability for any delay, denial, rejection, non-processing, incorrect processing, or adverse outcome resulting in whole or in part from inaccurate, incomplete, outdated, inconsistent, or misleading information provided by you.

3. Sole Responsibility for Product Selection and License Situation
You acknowledge and agree that you are solely and exclusively responsible for selecting the correct product, membership category, renewal option, license type, transfer option, status-change option, and any other payment or checkout selection applicable to your specific New Jersey real estate license situation. Payment submitted under an incorrect, inapplicable, or unauthorized option shall not entitle you to processing, approval, transfer, renewal, reactivation, status change, membership issuance, or any other result. If you select an incorrect option, NJ Real Estate Referral Company LLC may, in its sole discretion, reject the request, require resubmission, require corrected forms, require supplemental documentation, impose additional administrative requirements, require payment of additional fees, apply the payment to a different service if appropriate, place the matter on hold, or decline to process the request until all deficiencies are cured.

4. Payment Does Not Guarantee License Transfer, Renewal, Reactivation, or Approval
You expressly acknowledge that payment alone does not guarantee and shall not be construed as guaranteeing any transfer, renewal, reactivation, update, approval, brokerage affiliation change, membership activation, or other action relating to your real estate license. All requests are subject to internal review, verification, brokerage approval, regulatory compliance, documentation requirements, payment validation, and any applicable state, licensing, or third-party procedures or approvals. Your request shall remain pending, incomplete, or denied unless and until all applicable requirements are fully satisfied.

5. Assumption of Risk for Incorrect Selection or Noncompliance
You assume all risk associated with selecting an incorrect option, misunderstanding your own license situation, failing to satisfy renewal or continuing education requirements, failing to provide accurate information, failing to complete required steps, or otherwise failing to comply with applicable legal, regulatory, or procedural requirements. NJ Real Estate Referral Company LLC shall not be responsible or liable for any delay, denial, expiration, lapse, hold, rejection, loss of status, failure to transfer, failure to renew, failure to reactivate, missed deadline, additional cost, disciplinary issue, or other consequence arising from your acts, omissions, selections, or noncompliance.

6. Fees; Billing Authorization
You authorize NJ Real Estate Referral Company LLC and its payment processors to charge the payment method provided for all membership fees, renewal fees, administrative fees, processing fees, and any other charges associated with the products or services you select or request. You are responsible for maintaining a valid payment method and current billing information at all times. If a payment is declined, reversed, disputed, charged back, or otherwise not successfully processed, NJ Real Estate Referral Company LLC may suspend or refuse service, revoke pending processing, terminate membership, and pursue any lawful remedy available to recover amounts owed.

7. Automatic Renewal Authorization
Unless canceled before the applicable renewal date, membership shall automatically renew annually, and you expressly authorize recurring annual charges to the payment method on file at the then-current rate in effect at the time of renewal. You are solely responsible for monitoring your renewal date, maintaining valid payment information, and timely canceling if you do not wish to renew. Failure to receive a renewal reminder, email, invoice, or notice shall not relieve you of responsibility for recurring charges if authorization remains in effect.

8. Cancellation
You may request cancellation before the next renewal billing date to prevent future recurring renewal charges. Cancellation shall apply prospectively only and shall not affect fees already incurred, payments already processed, services already rendered, work already performed, or requests already under review or in process. Cancellation does not guarantee reversal of any charge and does not, by itself, terminate or alter any license relationship, regulatory status, or obligations already in effect.

9. Strict No-Refund Policy
All membership fees, renewal fees, administrative fees, processing fees, transfer-related fees, status-change fees, and other charges are final and non-refundable to the fullest extent permitted by law once any review, administrative action, account setup, record handling, payment processing, compliance review, document review, or other service-related activity has begun. No refund shall be required or owed merely because you selected the wrong product, misunderstood your eligibility, failed to qualify, changed your mind, failed to complete required steps, were denied by a regulator or third party, or experienced delay in processing. Any exception shall be made only if expressly approved in writing by NJ Real Estate Referral Company LLC in its sole and absolute discretion.

10. Compliance Obligations
You are solely responsible for understanding and complying with all laws, rules, regulations, licensing requirements, continuing education requirements, renewal deadlines, referral limitations, brokerage rules, and commission requirements applicable to your license and status. NJ Real Estate Referral Company LLC does not assume responsibility for monitoring your compliance obligations unless expressly stated in writing. Any information provided by NJ Real Estate Referral Company LLC is for general administrative purposes only and shall not be construed as legal advice, tax advice, regulatory advice, or a guarantee of compliance.

11. Right to Refuse, Suspend, Hold, or Terminate
NJ Real Estate Referral Company LLC may, at any time and without liability, refuse, delay, suspend, place on hold, or terminate any membership, renewal, transfer request, status change request, or related service if it determines, in its sole discretion, that:
(a) the information submitted is inaccurate, incomplete, or inconsistent;
(b) the selected product or option is incorrect or inapplicable;
(c) required documentation or approvals are missing;
(d) the request may violate applicable law, regulation, policy, or brokerage requirement;
(e) payment is unsuccessful, disputed, or reversed; or
(f) the request is otherwise unsuitable for processing.

12. No Liability for Processing Delays or Outcomes
To the fullest extent permitted by law, NJ Real Estate Referral Company LLC disclaims liability for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any lost income, lost commissions, lost opportunities, regulatory consequences, delays, denials, missed deadlines, licensing interruptions, or administrative errors arising out of or relating to any membership, payment, product selection, checkout selection, processing request, transfer request, renewal request, reactivation request, or reliance on any information provided through the website or services.

13. No Waiver; Reservation of Rights
Failure by NJ Real Estate Referral Company LLC to enforce any provision of these Membership Terms on one occasion shall not constitute a waiver of its right to enforce that provision or any other provision on any other occasion. All rights and remedies are cumulative and may be exercised independently or concurrently.

14. Member Acknowledgment and Binding Agreement
By checking out, submitting payment, enrolling, renewing, or otherwise using any membership or related service, you acknowledge that you have read, understood, and agreed to these Membership Terms; that you are solely responsible for selecting the correct option for your specific license situation; and that an incorrect selection, incomplete submission, or failure to satisfy applicable requirements may delay, prevent, or entirely defeat the processing of your requested license action or membership-related service.
